PRAYER: Criminal Original Petition filed under Section 528 of Bharatiya Nagarik Suraksha Sanhita (BNSS), 2023 to direct the respondents to take appropriate and immediate action on the complaints

lodged by the petitioner dated 23.01.2025 and 12.09.2025 and the representations dated 16.10.2025 and 22.10.2025 in accordance with law including the offences under the Scheduled Casts and Scheduled Tribes (Prevention of Atrocities) Act, 1989 and the Rights of Persons with Disabilities Act, 2016.

O R D E R

This Criminal Original Petition is filed seeking a direction to the respondents to take appropriate and immediate action on the complaints lodged by the petitioner dated 23.01.2025 and 12.09.2025 and the representations dated 16.10.2025 and 22.10.2025.

2. The learned counsel for the petitioner categorically submitted that the petitioner is a differently abled person belonging to Scheduled Caste community. There is a dispute between the petitioner and one Vasu in respect of pathway. The said Vasu and his family members have been creating trouble and abusing him in filthy language by mentioning his disability as well as his caste. Regarding the same, the petitioner lodged complaints to the fourth respondent police. However, so far, no action has been taken and hence, sought indulgence of this Court.

Per contra, learned Government Advocate (Crl.Side), Mr.M.Sakthi Kumar, on instructions, submitted that the petitioner has put up this narrative regarding being abused on castelines only for the purpose of this petition and in his original complaint, nothing has been stated as to whether he had been abused by the said Vasu and his family on castelines or his disability and the same has been invented by the petitioner for the purpose of this case. Hence, the petitions filed by the petitioner were closed on the basis of the facts mentioned in the petition before the respondent police.

4. The learned counsel for the petitioner in reply submitted that earlier the problem was resolved by the respondent police; however the problem still prevails and now the aggressors have managed to put up an iron gate and hence, sought indulgence of this court.

5. The learned Government Advocate (Crl.Side), on instructions, further submitted that the matter has already been seized by the Revenue Division Officer of Srirangam, Trichy District and only on obtaining a report from the RDO, the police can take further action.

6. This Court has heard both sides and perused the records.

Considering the submissions made by both sides, this Court is of the considered view that the police has to take immediate action by registering a first information report, if the petitioner is abused by the aggressors on castelines and the third respondent, Tahsildar, is also directed to take appropriate action against the aggressors under Section 7(3) read with 12 of the Rights of Persons with Disability Act, 2016 and the fourth respondent police is directed to take action under section 18(A)

of SC/ST (PoA) Act, 1989.

8. Accordingly, this Criminal Original Petition is disposed of.
