Saminathan ...Respondents Prayer: Writ Petition filed under Article 226 of Constitution of India, praying to issue a Writ of Mandamus, forbearing the respondents 1 to 5 from permitting the respondents 9 to 10 to illegally quarry stones in the petitioner's land to an extent of about 4 acres comprised in S.Nos.147/9, 148/4, 5D, 6, 145/4B, Veerapatti Village, Iluppur Taluk, Pudukottai District and consequently to direct them to restore the said land to its original position and to pay compensation thereof to the petitioner within the period that may be stipulated by this Court.

ORDER

The Writ Petition has been filed to forbear the respondents 1 to 5 from permitting the respondents 9 and 10 to quarry stones in the petitioner's land to an extent of about 4 acres comprised in S.Nos.147/9, 148/4, 5D, 6, 145/4B, Veerapatti Village, Iluppur Taluk, Pudukottai District and consequently to direct them to restore the said land to its original position and to pay compensation thereof to the petitioner.

The learned counsel appearing for the petitioner would submit that the petitioner's land is situated in S.Nos.147/9, 148/4, 5D, 6, 145/4B, Veerapatti Village, Iluppur Taluk, Pudukottai District, and the official respondents permitted the respondents 9 and 10 to carry on quarrying activities therein.

The learned Additional Government Pleader appearing for the respondents 1, 2, 4 to 7 would submit that this Court had granted an order of interim injunction on 15.12.2023 and now, the respondents 9 and 10 are not carrying on any quarrying activities. He would further submit that the subject land is petitioner's patta land and the official respondents would not permit the respondents 9 and 10 to carry on any further quarrying activities therein.

4. In reply, the learned counsel for the petitioner would submit that after the order of interim injunction, no quarrying activities are going on. He further prayed that the submissions of the learned Additional Government Pleader to the effect that the official respondents would not permit the respondents 9 and 10 to carry on quarrying activities in the petitioner's patta land may be recorded.

5. I have given due consideration to the submissions made on either sides.

There is no dispute on the fact that the respondents 9 and 10 are carrying out quarrying activities in the petitioner's land in S.Nos.147/9, 148/4, 5D, 6, 145/4B, Veerapatti Village, Iluppur Taluk, Pudukottai District. When patta stands in the name of the petitioner, without the permission of petitioner, the official respondents ought not have allowed the respondents 9 and 10 to carry on quarrying activities in the petitioner's land. It appears that after the order of interim injunction granted by this Court, quarrying activities have been stopped.
