PRAYER: Writ Petition is filed under Article 226 of the Constitution of India, to issue a Writ of Certiorari calling for the entire record relating to the closure

notice of the 2nd respondent dated 03.10.2025 and quash the same as illegal.

ORDER

The present writ petition has been filed seeking to quash the order passed by the second respondent herein dated 03.10.2025 wherein the petitioner has been directed not to operate his packaged drinking water unit without obtaining prior permission from the State Ground and Surface Water Resources Data Centre as well as from the Pollution Control Board.

According to the learned counsel appearing for the writ petitioner, these Rules were introduced only by way of G.O.(Ms).No.142, Public Works(R2) Department, dated 23.07.2014 and they are running the unit even before that. He also submits that on 30.10.2025, they have obtained “No Objection Certificate” from the State Ground and Surface Water Resources Data Centre and therefore, they are entitled to run the unit.

Per contra, the learned Special Government Pleader appearing for the first respondent submits that so far the petitioner has not obtained any certificate from the Pollution Control Board for running the said unit as contemplated under G.O.(Ms).No.142, Public Works(R2) Department, dated 23.07.2014. However, the learned counsel for the petitioner submits that for packaged drinking water unit, such a certificate is not required.

4. I have carefully considered the submissions made on either side and perused the materials available on record.

5. A perusal of G.O.(Ms).No.142, Public Works(R2) Department, dated

23.07.2014 clearly reveal that even for drawing of ground water, Tamil Nadu Pollution Control Board permission and ISI permission are required.

6. In view of the above said facts, in case, the petitioner is able to get “No Objection Certificate” from the Officer concerned of the Pollution Control Board, the petitioner can commence the operation of the water packaging unit.

Till such time, the petitioner cannot run the unit.

7. With the above said observations, this writ petition stands disposed of.

No costs. Consequently, connected writ miscellaneous petition is also closed.
