PRAYER : Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondents to pay pension for the period from 01.08.2023 to 19.10.2023 and difference in pension for the

period from 19.10.2023 to March 2024 with 10% interest to the petitioner.

O R D E R

This Writ Petition has been filed seeking a direction to the respondents to pay pension and the difference in pension for the relevant period together with interest at the rate of 10% to the petitioner.

2. Mr.S.Pavithra, learned Standing Counsel takes notice on behalf of respondents 1 & 2. As no adverse order is being passed against the 3rd respondent, notice to the 3rd respondent is dispensed with.

3. The petitioner was retired from the service of the respondent corporation on 31.07.2023 on account of superannuation and was paid 75% provisional pension from 01.08.2023 and paid till 19.10.2023 which was later recovered when full pension was sanctioned. Based on the revised basis pay of Rs.94,100/-, the petitioner is entitled to difference in pension for the period from 19.10.2023 to March 2024. Hence, the petitioner submitted a representation dated 28.09.2024 to the respondents claiming pension and the difference in pension for the relevant period however, the said representation has not been considered so far and therefore, in order to espouse the said cause, the petitioner has come up with the present Writ Petition.

4. Learned counsel for the petitioner submits that, it would suffice, if this Court issues a direction to the 1st respondent to consider the representation dated 23.09.2024 of the petitioner and pass appropriate orders on merits within the time that may be stipulated by this Court.

5. On the above contention, this Court heard the learned Standing Counsel appearing for respondents 1 & 2.

6. In view of the limited relief sought for by the petitioner, this Court without going into the merits of the case, directs the 2nd respondent to consider the petitioner’s representation dated 28.09.2024 and pass appropriate orders on the same on merits and in accordance with law, after affording an opportunity of personal hearing to the petitioner and aggrieved persons if any, within a period of six (6) weeks from the date of receipt of a copy of this order.

7. Accordingly, this Writ Petition is disposed with the aforesaid direction.

No Costs.
