PRAYER: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of CERTIORARIFIED MANDAMUS, calling for the records relating to the impugned order of the 1st Respondent in SCN/1049901743/25 dated 21.08.2025 and quash the same as illegal and consequently direct the 1st Respondent to renew/reissue the petitioner's passport on the basis of renewal application No.MD2075440201025 dated
04.08.2025 by considering the Petitioner's representation dated 04.09.2025.

O R D E R
The present Writ Petition has been filed seeking to quash the order passed by the first respondent wherein the request of the petitioner for renewal/ re-issuance of the passport has been rejected primarily on the ground that criminal cases are pending as against the writ petitioner.
2. The learned Government Advocate (Crl.Side) appearing for the second respondent brought to the notice of this Court that the petitioner has been implicated in a criminal case in Crime No.69 of 2015, on the file of the second respondent police, which has culminated in filing of charge sheet in C.C.No.305 of 2018 on the file of the Additional Mahila Court (Magistrate Level), Nagercoil at Kanyakumari.
3. According to the learned counsel appearing for the petitioner, Non-
Bailable Warrant has been issued to the first accused, but the petitioner is the second accused. In view of the above said facts the trial is not able to be proceeded with.
4. Considering the above said facts, the petitioner is directed to approach the trial Court concerned seeking permission of the Court to go abroad. Based upon the order passed by the Additional Mahila Court (Magistrate Level), Nagercoil at Kanyakumari, the first respondent is directed to proceed in accordance with law.
5. With the above said observation, this Writ Petition stands disposed of. There shall be no order as to costs.
