ORDER

This writ petition has been filed seeking issuance of a Writ of Mandamus directing the respondent to change the mother’s name as Thresmary and the father’s name as Selvam in the Mark Statement-cum- Certificate of the Secondary School Examination, 2020, bearing Registration No.M120/46117/003 dated 15.07.2020, issued in the name of the petitioner’s son, Aswin Santha Kumar, by considering the petitioner’s representation dated 04.02.2023.

The petitioner submits that out of her lawful wedlock with her husband, Selvam, her son Aswin Santha Kumar was born on 19.04.2005 at Maniraj Maternity Hospital, Sattur, and his birth was duly registered with the competent authority, pursuant to which a Birth Certificate bearing Registration No.283/2005/01 dated 25.04.2005 was issued. It is further submitted that the petitioner’s son completed his Secondary School Education in the year 2020 at LLB Shastri Public School, Sattur, and the respondent issued the Mark Statement-cum-Certificate dated 15.07.2020. While the name of the petitioner’s son is correctly mentioned therein, the names of the parents were wrongly shown as Gladis Ivy (mother) and DMS.

Prem Kumar (father), instead of the petitioner and her husband, namely Thresmary and Selvam.

It is submitted that the petitioner’s son subsequently completed the Senior School Certificate Examination (XII Standard) in the year 2022, and in the Marks Statement-cum-Certificate issued for the said examination, the names of the parents are correctly mentioned as Thresmary and Selvam. However, the error in the Secondary School Examination certificate continues to remain uncorrected. Despite representations made to the authorities, including the respondent, the error has not been rectified. The petitioner’s representation dated 04.02.2023, received by the respondent on

07.02.2023, has not been acted upon.

4. This Court had summoned the petitioner, Mrs.Gladis Ivy, and Mr.DMS. Prem Kumar. Upon interaction, it came to light that the child was initially left at an orphanage run by Mrs.Gladis Ivy and Mr.DMS.Prem Kumar by the father, without the knowledge of the mother, and therefore, their names were entered as parents in the initial school records. Subsequently, the petitioner traced her son, joined the same orphanage, and thereafter all documents were corrected to reflect the names of the biological parents, namely Thresmary and Selvam. All subsequent records, including the Birth Certificate, Senior School Certificate, Community Certificate, and other documents, reflect the correct names of the parents.

5. This Court, having interacted with all the concerned persons and upon perusal of the records, is satisfied that the biological parents of the child Aswin Santha Kumar are only Thresmary and Selvam, and the same is borne out by all other documents.
