PRAYER : Petition filed under Article 226 of the Constitution of India praying for the issuance of a Writ of Mandamus directing the respondent to issue passport to the petitioner in File No.MA1074937767925 with the correct date of birth as 09.11.1975 instead of 09.11.1972 as per the birth certificate and school records of

the petitioner.

This Writ Petition has been filed seeking a direction to the respondent to issue passport to the petitioner by incorporating the correct date of birth as 09.11.1975 instead of 09.11.1972 as per the birth certificate and school records of the petitioner.

2. Mr.R.Subramanian, learned Additional Central Government Standing Counsel takes notice on behalf of the respondent.

3. It is the case of the petitioner that he obtained his passport in the year

1995 wherein, his date of birth has been erroneously recorded as ‘09.11.1972’ instead of ‘09.11.1975’. Thereafter, he applied for renewal of passport in the year 2024 and sought for correction of date of birth in the passport. However, the said request was not considered and the passport was once again issued by mentioning the incorrect date of birth as ‘09.11.1975’. Subsequently, the petitioner submitted an application on 27.03.2025 for re-issuance of passport enclosing all the necessary supporting documents. As no response was forthcoming from the respondent, the petitioner has come up with the present Writ Petition seeking the aforesaid relief.

4. Learned counsel for the petitioner submitted that, a similar issue has already been dealt with by the Delhi High Court in case of Sunita Sawhney Vs. Union of India & Ors in W.P (C) 10839 of 2015 dated 03.12.2015 and therefore, it is prayed that this Court may pass a similar order in this Writ Petition as well.

5. On the above contention, this Court heard the learned Additional Central Government Standing Counsel for the respondent.

In view of the submission made by the learned counsel for the petitioner as also the judgement referred to supra, the issue involved in the present case being identical in nature, the same is squarely applicable to the facts of the present case as well. Accordingly, the respondent is directed to consider the petitioner’s application dated 27.03.2025 for re-issuance of passport with correct date of birth and pass appropriate orders on the same in accordance with law in the light of the Judgement passed by the Delhi High Court in W.P (C) 10839 of 2015 dated 03.12.2015 within a period of six (6) weeks from the date of receipt of a copy of this order.

7. This Writ Petition stands disposed of in the above terms. There shall be no order as to costs.
