O R D E R
The present Criminal Original Petition has been filed seeking a
direction to the respondent Police to provide police protection to the
petitioner and her family members.
2. The case of the petitioner is that there exists a property dispute between the petitioner and her neighbour, one Raghuram and a suit is also pending in O.S.No.137 of 2025 in respect thereof. It is alleged that the said Raghuram, along with his henchmen, trespassed into the petitioner’s property and disturbed her peaceful possession. Therefore, the petitioner has sent a representation dated 15.11.2025 to the first respondent Police. Since no action has been taken by the respondent Police, the present petition has been filed.
3. Learned Government Advocate (Criminal Side) appearing for the respondent Police, on instructions, submitted that on account of the property dispute, the petitioner and her neighbour used to have frequent quarrels, resulting in frequent skirmishes and a civil suit is also pending between them. Based on the complaint given by the petitioner, a case was registered in Crime No.617 of 2025 for the offences under Sections 296(b), 115(2), 118(1) and 351(2) of the BNS on 20.11.2025. Further, based on the counter complaint given by one Amaravathi, a case in Crime No.616 of 2025 was registered against the petitioner and others for the offences under Sections 296(b), 115(2), 118(1) and 351(2) of the BNS on the same day. The investigation in both cases is pending and the second respondent Police will file the final report at the earliest. He further submitted that the respondent Police are taking steps to prevent any law and order issue arising owing to the disputes from the aforesaid parties.
4. Recording the submission made by the learned Government Advocate (Criminal Side), this Criminal Original Petition stands closed. The respondent Police are directed to continue with the investigation in both cases and file the final report in accordance with law.
