Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the second respondent to picking up and relocate the dogs in the shelter which are raising by the fourth

respondent based on his representation dated 14.07.2025.

ORDER

This writ petition has been filed seeking issuance of a Mandamus directing the second respondent to picking up and relocate the dogs in the shelter which are raising by the fourth respondent based on his representation dated 14.07.2025.

2. It is the case of the petitioner that the fourth respondent who is the neighbour of the petitioner, is raising 7 dogs at her house without obtaining requisite permission or license from the second respondent or any other competent authorities. It is further alleged that the fourth respondent is not properly maintaining the said dogs and routinely leaves them on the street while she goes, as a result, the dogs roam freely in the locality and exhibiting intimidating behaviour towards the public and posing a threat of biting, thereby causing inconvenience and danger to the residents in the area. In this regard, the petitioner submitted representation to the first respondent, who in turn forwarded the same to the second respondent. However, the second respondent has not taken any steps. Hence, the petitioner has approached this Court.

3. This Court, by order dated 19.11.2025, directed the fourth respondent to file an affidavit that she shall keep her two dogs within her premises and not let it outside her premises. The other dogs, if any, shall be removed in compliance with the order passed by the Hon'ble Supreme Court in suo motu case in W.P(C).No.5 of 2025, dated 07.11.2025.

4. In compliance of the aforesaid order, the fourth respondent filed an undertaking affidavit stating that she will ensure that her two dogs are kept within her compound and will not let them out.

5. This Court also directs the petitioner that when she walks her dogs she shall ensure that the dogs have a mouth guard fixed before they are taken out.

6. In view of the above, this Writ Petition is disposed of. No costs.
