Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus, (a) to call for the records pertaining to the proceedings of the third respondent vide C.No.A2/4500/2017 dated 13.04.2023 and quash the same as illegal and arbitrary in so far denying the right of seniority and monetary benefits to the petitioner, (b) to call for the records pertaining proceedings of the 5^th Respondent vide No.C.No.A3/9269/578/2025 dated 25.09.2025 and to quash the same as illegal and consequently direct the respondents to grant seniority and monetary benefits to the petitioner on par with other candidates of the 2017 batch in line with the order dated 11.01.2019 made in W.A.No.2759 of 2018 of this Hon’ble Court.

ORDER

This writ petition has been filed challenging the order dated 13.04.2023, thereby rejecting the request made by the petitioner claiming seniority on par with the persons who were recruited under the same recruitment notification and also challenging the order passed by the fifth respondent dated 25.09.2025. 2. Heard the learned counsel on either side and perused the materials available on record.

3. The petitioner had applied for the post of Grade II Police Constable, as per the notification of the year 2018. However, his candidature was rejected, on the ground that he had involved in a criminal case in Crime No.471 of 2013 registered for the offences punishable under Sections 294(b), 355, 353 and 506(i) of IPC, on the file of the Sub-Inspector of Police, Ulundurpet Police Station. Therefore, the petitioner was not qualified for appointment to the post of Grade-II Police Constable. The criminal case ended in acquittal in C.C.No.12 of 2014.

4. Therefore, the petitioner challenged the rejection of his candidature in W.P.No.7879 of 2018. This Court, by an order dated 09.04.2018 dismissed the writ petition. Aggrieved by the same, the petitioner preferred a writ appeal in W.A.No.2759 of 2018. This Court, by the Judgment dated 11.01.2019, allowed the appeal and directed the respondents to appoint the petitioner herein as Grade II Police Constable and send him for training along with the batch of Police Constables, if any undergoing training or in future. Thereafter, the said order was not complied with and as such, the petitioner filed a contempt petition. Pending contempt petition, the third respondent filed a review application and only after the dismissal of the review application, the petitioner was appointed as Grade II Police Constable, by an order dated 13.04.2023. In the said order, there was a condition that the petitioner shall not seek for seniority or other monetary benefits, on par with the successful candidate under common recruitment notification. Further, his service will be reckoned from the date of the present appointment orders and he will be sent for basic institutional training along with the next batch candidates. After a period of two years from the date of his appointment, now the petitioner challenged the appointment order, insofar as denial of seniority and other monetary benefits.
