Prayer:

Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the respondents 1 to 4 to shift and redirect the High Tension Electricity Lines over the petitioner property situating at Plot No.5 in Mullai Nagar, C.K.Ashram, Kathirimangalam Panjayath union, Tirupattur to redirect over in the 10 feet public lane based on the application of the petitioner dated 10.07.2023 registered as No.4140723693 before third respondent.

O R D E R

This writ petition has been filed seeking issuance of Writ of Mandamus directing the respondents 1 to 4 to shift and redirect the High Tension Electricity Lines over the petitioner property situating at Plot No.5 in Mullai Nagar, C.K.Ashram, Kathirimangalam Panjayath union, Tirupattur to redirect over in the 10 feet public lane based on the application of the petitioner dated 10.07.2023 registered as No.4140723693 before third respondent.

2.The learned counsel appearing for the petitioner submitted that the petitioner made representation dated 10.07.2023 to the respondents seeking to shift and redirect the High Tension Electricity Lines over the petitioner property at Plot No.5 in Mullai Nagar, C.K.Ashram, Kathirimangalam Panjayath union, Tirupattur to redirect over in the 10 feet public lane and subsequently, the third respondent also issued demand notice for the deposit cost estimation amount of Rs.10,165/- to the petitioner and the petitioner also paid the necessary charges, however, there is no further action. Hence, this Court may without going into the merits of the case, issue direction to the respondents to pass appropriate orders on the petitioner’s representation within a reasonable timeframe.

3.Considering the limited relief now sought for by the learned counsel appearing for the petitioner, this Court, without expressing any opinion on the merits of the case, directs the respondents to consider the petitioner’s representation dated 10.07.2023 on merits and in accordance with law and pass appropriate orders, within a period of six weeks from the date of receipt of a copy of this order.

The writ petition is disposed of. No costs.
