Prayer: Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the 1st Respondent to dispose the enquiry proceedings in Na.Ka.No. 3217/m2/2025 in regard with cancellation of illegal Form VI and VII for the year of 2023-24 registered by the 2nd respondent on the file of the 1st respondent as the same has been done in the name of deceased person namely Krishnan and pass such further or other orders as this Honble court may deem fit and proper in the circumstances of this case and thus render

justice.

ORDER

The above writ petition has been filed for the following relief:-

“Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Mandamus directing the 1st Respondent to dispose the enquiry proceedings in Na.Ka.No. 3217/m2/2025 in regard with cancellation of illegal Form VI and VII for the year of 2023-24 registered by the 2nd respondent on the file of the 1st respondent as the same has been done in the name of deceased person namely Krishnan and pass such further or other orders as this Honble court may deem fit and proper in the circumstances of this case and thus render justice”

2. Mr.G.V.Vairam Santhosh, learned Additional Government Pleader takes notice on behalf of the respondents 1 and 2.

3. By consent of both parties, the writ petition is taken up for final disposal at the admission stage itself.

4. The brief facts as set out in the affidavit filed in support of the writ petition reads as follows:-

The petitioner would submit that he is the member of Thiruppuvanam Nadargal Uravinmurai Welfare Society, which consists of 152 to 180 active members. The said society was originally formed in the year 1970 in the name and style of Thirupuvanam Kottai Nelmuraikarai Nadar Uravinmuram Sangam and the same was registered in the name and style of Thiruppuvanam Nadargal Uravinmurai Welfare Society on

01.03.2013.

5. He would submit that the society has not functioned properly for the past 12 years and the audit report has not been filed for the past 10 years. The officer bearers and the 2^nd respondent society had misappropriated the funds of the said Sangam. In this connection, he had filed a complaint before the Thiruppuvanam Police Station, Sivagangai District and CSR was also issued. However, the same was closed stating that it is a civil dispute. Thereafter, the 2^nd respondent without conducting any general body meeting had filed audit reports, Form VI and Form VII before the 1^st respondent for the year 2023 to 2024, which constitutes the clear violation of law.

6. He would submit that he had received a WhatsApp message stating that he and three others were removed from membership. However, Form VI and Form VII documents registered by the society itself show him as one of the members. Thereafter, he had made a representation dated 28.07.2025 to take against against the 2^nd respondent. Upon receiving the same, the 1^st respondent issued summons to the 2^nd respondent to attend an enquiry.

He would further submit that a perusal of the Form VII and other documents submitted by the 2^nd respondent clearly shows that the 2^nd respondent had paid the registration fees and filed the documents/records in the name of erstwhile President late Mr.Krishnan, who had died as early as on 28.01.2021. Therefore, the documents/records filed by the 2^nd respondent are bogus documents. He would further submit that the 2^nd respondent had failed
