PRAYER: Petition filed under Article 226 of the Constitution of India, to issue
a writ of Mandamus to direct the respondents to publish the reserve list for each communal category in pursuant to the provisional selection list published by the third respondent vide his proceedings Nil, dated 31.05.2025 in pursuant to the notification issued by the third respondent vide notification No.01/2024 dated 09.02.2024 in accordance with Section 3(u) of the Tamil Nadu Government Servants (Conditions of Service) Act, 2016 and consequently to direct the respondents to consider the petitioner for appointment to the post of Secondary Grade Teacher under BCM (Women) (PSTM) category on the basis of marks secured by her, within the stipulated time fixed by this Court.

This Writ Petition had been filed to direct the respondents to publish the reserve list for each communal category in pursuant to the provisional selection list published by the third respondent vide his proceedings Nil, dated 31.05.2025 in pursuant to the notification issued by the third respondent vide notification No.01/2024 dated 09.02.2024 in accordance with Section 3(u) of the Tamil Nadu Government Servants (Conditions of Service) Act, 2016 and consequently to direct the respondents to consider the petitioner for appointment to the post of Secondary Grade Teacher under BCM (Women) (PSTM) category on the basis of marks secured by her, within the stipulated time fixed by this Court.
2. Heard Mr.Mohammed Zamil, the learned counsel appearing for the petitioner, Mr.N.Satheesh Kumar, learned Additional Government Pleader appearing for the first and second respondents and Mr.T.Amjadhkhan, learned Government Advocate appearing for the third respondent.
3. The learned counsel appearing for the petitioner would submit that the petitioner having qualification is eligible to be appointed as a Secondary Grade Teacher or B.T. Assistant. He would submit that the third respondent herein has issued a notification on 25.10.2023 inviting applications for the post of Graduate Assistants/BRTE-2023 for which the petitioner had also submitted her application. It had also issued a further notification on 09.02.2024, for the post of Secondary Grade Teacher for which also the petitioner had made her application. A provisional selection list for the post of Secondary Grade Teacher was published on 30.04.2025 wherein the petitioner's name was also found and was called for certificate verification on 14.05.2025 and a final provisional selection list was also published on
31.05.2025. As the 'Reserve List' was not published, the petitioner had made a representation to the third respondent to publish the 'Reserve List', but however, the same was not published. Hence, the petitioner had approached this Court.
4. He would further submit that in terms of 3(u) of the Tamil Nadu Government Servants (Conditions of Service) Act, (hereinafter referred to as the 'Act'), it is the duty to publish a 'Reserve List'. In that context, he would also rely upon a judgment of the Division Bench of this Court in the case of M.S.Kalaivani vs. Secretary, TNPSC, Chennai & Anr., reported in 2025 SCC Online Mad 2076 in support of his contentions.
