2025 Supreme(Online)(Mad) 76502

IN THE HIGH COURT OF JUDICATURE AT MADRAS
K.Kumaresh Babu, J
P.Rekha – Appellant
Versus
The State of Tamil Nadu – Respondent
W.P.(MD) Nos. 23881, 24323, 24108 and 24645 of 2025

Advocates:
For the Appellants/Petitioners: Mr.V.R.Shanmuganathan
For the Respondents: Mr.N.Satheesh Kumar, Additional Government Pleader

The 2% reservation quota for ministerial staff recruitment by transfer in the Education Department is subject to the specific percentage breakdown (promotional, total substantive, or direct recruitment) as dictated by the applicable Special Rules effective during the respective historical periods of the vacancies.

Headnote:(A) Constitution of India - Art. 309 - Tamil Nadu School Educational Subordinate Service Rules - Tamil Nadu Higher Secondary Education Service Rules - 2% Reservation for Ministerial Staff - Recruitment by transfer - Calculation of vacancies - Calculation of 2% reservation quota for ministerial staff in School Education Department and Higher Secondary Education Department through transfer recruitment must adhere strictly to the evolving service rules, shifting between promotional vacancies, total substantive vacancies, and direct recruitment vacancies depending on the specific amendments effective from 2007, 2020, 2024, and 2025 respectively. (Paras 19, 21, 31, 32)

Facts of the case:
The petitioners, ministerial staff in the School Education Department, sought to quash impugned proceedings and mandate the publication of a year-wise panel from 2007-2008 to fill backlog vacancies under a 2% reservation quota earmarked for ministerial staff. They contended that previous recruitment processes failed to transparently account for available vacancies and properly apply prevailing service rules. The respondents argued that vacancies had been filled according to the applicable service rules at the relevant times and that ministerial staff could not claim seniority for vacancies arising before they were appointed to the feeder cadre.

Findings of Court:
The court clarified that the 2% reservation must be calculated differently across several periods, moving from promotional vacancies to total substantive vacancies and finally to direct recruitment vacancies following statutory amendments to the Tamil Nadu School Educational Subordinate and Higher Secondary Education Service Rules, dismissing the petitioners' broad demand for uniform application from 2007.

Issues: Which calculation methodology applies to the 2% reservation quota for transfer recruitment, and whether the respondent is required to recalculate and publish all vacancies since 2007?

Ratio Decidendi: Reservation entitlements must be interpreted based on the legal framework in force at the time the vacancy arose; specifically, the 2% quota must follow the evolving shift from promotional to total substantive to direct recruitment pools as mandated by successive amendments to the service rules.

Result: Writ petitions disposed of with directions for the respondents to publish vacancy lists and details for BT and PG Assistants since 2007 and 2011 respectively.

4. Mr.V.R.Shanmuganathan learned counsel for the petitioner would submit that the petitioners have joined the services as ministerial staff in the Education Department as Junior Assistant and Typist. As there was no promotional avenue for the ministerial staffs under the Education Department, the Government had issued orders in G.O.(Ms).No.175, School Education Department dated 19.07.2007 creating 2% promotional avenue as recruitment through transfer in the vacancies in the post of BT Assistant/ graduate teachers. Similar Government orders were issued in G.O.(4D).No.21, School Education Department dated 02.11.2011 for the vacancies in the post of PG Assistants. However, the said Government orders were kept in abeyance by G.O.(2D).No.53, School Education Department dated 27.08.2014 until the Special Rules operating the field were appropriately amended. Under G.O.(Ms).No.7, dated 20.01.2020, 2% of the 50% vacancies earmarked for promotion was to be made through recruitment by transfer from among the ministerial staffs working in the School Education Department provided that they were qualified, by way of an amendment to the Tamil Nadu School Education Subordinate Service Rules which govern the post of BT Assistant. By a further Government orders in G.O.(Ms).No.13 dated 30.01.2020 and G.O.(Ms).No.14, dated 30.01.2020, new Rules were framed for both Tamil Nadu School Educational Subordinate Services and Tamil Nadu Higher Secondary Education Service Rules by superseding the respective existing Rules.
