PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus, calling for the records relating to the impugned proceedings of the 2^nd respondent dated 28.02.2024 made in R.No.156/A6/2024 suspending the petitioner on the penultimate day of her retirement i.e., on 28.02.2024 and the consequential

charge memo dated 28.02.2024 made in memo R.No.156/A6/2024, quash the same and consequently direct the 2^nd respondent herein to permit the petitioner to allow to retire on her attaining superannuation with all monetary benefits.

O R D E R

This Writ Petition has been filed challenging the impugned proceedings of the 2^nd respondent dated 28.02.2024, suspending the petitioner on the penultimate day of her retirement i.e., on 28.02.2024 and the consequential charge memo dated 28.02.2024 made in memo R.No.156/A6/2024, quash the same and consequently direct the 2^nd respondent herein to permit the petitioner to allow to retire on her attaining superannuation with all monetary benefits.

2. The learned counsel appearing for the petitioner would submit that the petitioner joined as Typist in the office of the 2^nd respondent in the year

1994. While she was working as Superintendent she was placed under suspension for some audit issue. He would further submit that the petitioner already retired on 29.02.2024 however, till date, enquiry was not concluded to enable the petitioner to get the terminal benefits.

3. The learned counsel appearing for the petitioner would submit that this Court issue a direction to the respondents to conclude the disciplinary proceedings as against the petitioner and settle the terminal benefits within a stipulated time.

4. The learned Government Advocate appearing for the respondents would submit that the disciplinary proceedings as against the petitioner will be concluded within a time fixed by this Court.

5. In view of the same, there shall be a direction to the respondents to conclude the disciplinary proceedings as against the petitioner within a period of six weeks from the date of receipt of a copy of this order. Upon completion of the enquiry, if the petitioner is entitled to terminal benefits, the respondents are directed to disburse the same to the petitioner within a period of four weeks, thereafter.

6. This Writ Petition is disposed of with the above terms. No costs.

Consequently, connected miscellaneous petition is closed.
