This Writ Petition is filed seeking a Mandamus as against the respondents to accord permission/no objection for constructing bridge in the eastern side of the land comprised in Old Survey No.643/1, New T.S.No.32/1, Block No.3, Ward B, Chinnamanur, Uthamapalayam Taluk, Theni District at our cost by considering the representations dated 20.08.2024, 06.05.2025 and 02.09.2025 within a stipulated time period in accordance with law.
2. By consent, this Writ Petition is taken up for final disposal at the admission stage itself.
3. The petitioner has given a representation on 20.08.2024, seeking permission/no objection for constructing bridge in the eastern side of the land comprised in Old Survey No.643/1, New T.S.No.32/1, Block No.3, Ward B, Chinnamanur, Uthamapalayam Taluk, Theni District. Since the same was not considered, the petitioner has approached this Court by way of this Writ Petition.
4. The learned Additional Government Pleader appearing for the respondents, after taking instructions, would submit that based on the representation of the petitioner dated 20.08.2024, the first respondent has passed an order dated 25.09.2024, rejecting the request of the petitioner and the said order has been forwarded to the petitioner. Therefore, without challenging the order dated 25.09.2024, the petitioner cannot make another representation. Hence, she prays for dismissal of the Writ Petition.
5. A perusal of the order dated 25.09.2024, reveals that the petitioner's request for constructing bridge in the eastern side of the land was rejected on the ground that the subject land is a patta land. Such being the case, the right course available to the petitioner is only to challenge the order dated 25.09.2024, in the manner known to law.
6. The learned counsel appearing for the petitioner would submit that the order dated 25.09.2024 has not been served to the petitioner.
7. Considering the said submission, this Court directs the respondents to serve the copy of the order dated 25.09.2024, to the petitioner within a period of two weeks from the date of receipt of a copy of this order. After receipt of the same, it is for the petitioner to challenge the same in the manner known to law.
8. With the above observations, this Writ Petition stands disposed of. There shall be no order as to costs.
