Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the ineligible list issued by the 3rd respondent dated 20.11.2019 and quash the same and direct the third respondent to include the petitioners name in the Revised Provisional Selection List

dated 21.10.2021 for the Post Graduate Assistant Teacher in Tamil pursuant to the notification by the third respondent dated 12.06.2019 for direct recruitment for the posts of Post Graduate Assistants/ Physical Education Directors Grade -1-2018-2019. ORDER

The present writ petition has been filed by the aspirants to the post of PG Assistant (Tamil) challenging the order passed by the 1st respondent, wherein the petitioner's name has been catalogued in the ineligible list.

2. The petitioner has undergone B.Lit degree for the academic year

2005-2006 and thereafter, got admission to M.A. Tamil Course. After completing the 1st year, she had discontinued M.A. Tamil Course and joined B.Ed Course in the year 2007 and completed the same in the year 2008. Thereafter, the petitioner has reverted back to MA course and completed the same in the year 2009. Therefore, it is clear that the petitioner has undertaken the PG Course as well as the B.Ed course simultaneously.

3. In view of the above said facts, the 3rd respondent has chosen to place the petitioner in the ineligible list. This order is put to challenge in the present writ petition.

4. According to the learned counsel appearing for the petitioner, the petitioner had discontinued M.A. Tamil Course in the year 2007 and thereafter, joined B.Ed Course and therefore, it cannot be a considered to a simultaneous degree.

5. However, the learned Government Advocate appearing for the

3rd respondent pointed out that if the petitioner had discontinued M.A. Tamil Course in the year 2007 permanently, then the submissions of the petitioner could be accepted. However, the petitioner had reverted back to M.A. Tamil Course and re-joined in the M.A. Tamil Course in the 2nd year in the year 2008 and proceeded to get a M.A. Tamil in the year 2009. Therefore, the M.A. Degree as well as the B.Ed. Degree should only be construed to have been obtained simultaneously.

The learned counsel appearing for the 3rd respondent also relied upon the Judgement of the Hon'ble Division Bench of this Court reported in 2018 (6) Mad LJ 545, wherein, in a similar case, the Hon'ble Division Bench was pleased to confirm the order of the Writ Court where the candidate was found ineligible for obtaining simultaneous degree.

7. In view of the above said facts, this Court find does not find merits in the writ petition. Accordingly, the writ petition stands dismissed.

No costs. Consequently, connected miscellaneous petitions are closed.
