The prayer sought for herein is for a writ of mandamus to direct the respondents to consider and pass orders on the petitioner’s representation dated 28.06.2025 as per the provisions of the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014 and till such time, not to disturb the running of the petitioner’s bunk shop at M.R.C.Nagar near Sun TV office, wherein Tea, Coffee, Tiffin, Snacks and other food are sold.

The petitioner claimed that she has been running a bunk shop at M.R.C.Nagar, near Sun TV office, wherein she is selling tea, coffee, tiffin, etc., and in order to get licence under the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014, she had made a representation on 28.06.2025 and to consider the same and to pass orders, seeking a writ of mandamus, the present writ petition has been filed.

3. Heard Mr.M.Ramadoss, learned counsel appearing for the petitioner, Ms.P.T.Ramadevi, learned Standing Counsel appearing for the first respondent Corporation and Mr.M.Murali, learned Government Advocate appearing for the second respondent.

Ms.P.T.Ramadevi, learned Standing Counsel appearing for the first respondent Corporation would submit that, insofar as the place where such permission sought for by the petitioner through her representation already been declared to be a Non-vending Zone, therefore, such permission cannot be granted. Therefore, alternatively, if the petitioner is ready and willing to make an application in the prescribed format to the Town Vending Committee to seek for such permission in any Vending Zone in the nearby locality as already been declared so by the Town Vending Committee, such kind of application can be considered by the respondent Corporation through the Vending Committee, she contended.

5. In view of the said submission made by the learned Standing Counsel appearing for the first respondent Corporation, this Court is inclined to dispose of the writ petition with the following orders:

that it is open to the petitioner to give an application in the prescribed format to the Town Vending Committee or the Zone Town Vending Committee of the respondent Corporation concerned for seeking such permission under the Street Vendors (Protection of Livelihood and Regulation of Street Vending) Act, 2014 in any of the Vending Zones in the nearby locality or any other convenient place for the petitioner and if any such application in the prescribed format is made to the Town Vending Committee, the same shall be considered and necessary orders on merits to be passed by the Town Vending Committee as well as the Chennai Corporation.

6. With these observations and directions, this Writ Petition is disposed of. However, there shall be no order as to costs.
