of India, to issue a Writ of Certiorarified Mandamus to set aside the proceedings of the 2^nd respondent in Na.Ka.No.001/NKL PS/2026 dated 08.01.2026 and consequently directing the 1^st and 2^nd respondents to provide a police protection for conducting annual day function of Park Public

School, Vinayaka Gardens, Periyapatti, Namakkal on 09.01.2026 refraining the private respondents from unlawfully interfering in conducting the annual day function of the school.

O R D E R

This writ petition (criminal) has been filed seeking quashment of the proceedings of the 2^nd respondent bearing Na.Ka.No.001/NKL PS/2026 dated 08.01.2026 and for a consequential direction to the 1^st and 2^nd respondents to provide police protection for conducting annual day function of Park Public School, Vinayaka Gardens, Periyapatti, Namakkal on 09.01.2026, by refraining the private respondents from unlawfully interfering in conducting the said function.

2. Mr.S.Santhosh, learned Government Advocate (Crl. Side), takes notice on behalf of the 1^st and 2^nd respondents. In view of the consent expressed by the learned counsel on either side, this writ petition (criminal)

is taken up for final disposal at the admission stage itself.

3. Since no order adverse to the interest of the respondents 3 to 6 is passed, notice to the said respondents is dispensed with.

Learned counsel for the petitioner submitted that the petitioner is the Founder Trustee and Correspondent of Selva Vinayaka Educational Trust and Correspondent of Park Public School, Namakkal and the private respondents herein are expelled members of the above said trust. He further submitted that it has been proposed to conduct Annual Day function on 09.01.2026 (today) at 04.30 pm in the school premises. While so, the private respondents herein are circulating posters containing misleading and provocative statements around the school premises, in order to create ruckus and to obstruct the annual day function. Aggrieved, the petitioner made representations before the 1^st and 2^nd respondents, both dated 08.01.2026, seeking permission for conducting annual day function and also police protection therefor. However, the 2^nd respondent, vide proceedings dated 08.01.2026 bearing Na.Ka.No.001/NKL PS/2026, refused to grant permission for conducting annual day function, which is not sustainable.

Accordingly, he prayed for appropriate orders.

5. Learned Government Advocate (Crl. Side) appearing for the 1^st and 2^nd respondents, on instructions, submitted that though the 2^nd respondent, vide impugned proceedings, refused to grant permission for conducting Annual Day function, initially, however, the respondent police have agreed to grant protection for conducting Annual Day function today i.e., 09.01.2026 from 04.00 pm in the premises of Park Public School, pursuant to the oral undertaking given by the private respondents inter alia to the effect that they will not cause any hindrance in the conduct of the Annual Day function. He further submitted that the rehearsal for the said function is already going on in the school premises. He also produced a communication of the 2^nd respondent dated 09.01.2026 addressed to him to that effect before this Court today, wherein it has been stated as hereunder:
