PRAYER: Petition filed under Article 226 of the Constitution of India to issue a Writ of Habeas Corpus, to direct the 2^nd respondent to produce the petitioner’s husband namely V.Arjunan, S/o.Vedhachalam, male, aged about 56 years, before this Court and set him at liberty. This Writ of Habeas Corpus Petition is filed seeking a direction to the second respondent-Police to produce the petitioner’s husband namely V.Arjunan, S/o.Vedhachalam, male, aged about 56 years, before this Court and set him at liberty.

2. It is the case of the petitioner that she along with her family members, had gone to Varanasi. On 27.08.2025, while returning to Chennai, they were waiting at Varanasi Junction Railway Station. At that time, the petitioner’s husband viz., V.Arjunan, S/o.Vedhachalam, male, aged about 56 years, who was under the influence of alcohol, inadvertently boarded the wrong train from Varanasi and has been missing since 27.08.2025. After returning to Chennai, the petitioner lodged a complaint before the second respondent-Police, pursuant to which a case in Crime No.702 of 2025 was registered on 29.08.2025 for “Man Missing”. However, the respondents-police have not taken effective steps to trace and secure him, necessitating the filing of the present petition.

The learned Additional Public Prosecutor appearing for the respondents-Police submitted that, since the detenu was found missing at Varanasi, the second respondent-Police forwarded the complaint to the Varanasi Police. It is further submitted that a status report has been received from the Sub Inspector of Police, Police Station GRP CANNT, Varanasi Section, Prayagraj, Uttar Pradesh, wherein it is stated that, upon receipt of the complaint, investigation is in progress and that, despite earnest efforts, the detenu has not yet been traced out. It is further stated that continuous efforts are being taken to trace the detenu.

4. Inasmuch as case has already been registered and investigation is in progress and as it is not the case of the petitioner that the detenu was illegally kidnapped or abducted and he has not been illegally detained, but only a case of a man missing, this Habeas Corpus Petition is liable to be closed and is accordingly closed.

5. The respondents/police are directed to effectively follow up the case with the Varanashi Police and proceed further in accordance with law.
