PRAYER: Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Habeas Corpus, directing the respondents 1 to 3 to produce a body of person / detenue namely Shanmugaraj, S/o.Balamurugan, aged about 19 years, before this Court and set him at

liberty

O R D E R

(Order of the Court was made by G.K.ILANTHIRAIYAN, J.

This Habeus Corpus Petition has been filed to direct the respondents 1 to 3 to produce a body of person / detenue namely Shanmugaraj, S/o.Balamurugan, aged about 19 years, before this Court and set him at liberty

2. The petitioner is the father of the detenue. The detenue is aged about 20 years. While being so, the detenue was missing from the house from 07.10.2025, therefore the petitioner lodged complaint before the third respondent alleging that he went along with the fourth respondent. On receipt of the complaint the third respondent conducted enquiry and registered a case in Crime No. 247 of 2025 under Man Missing. During investigation it was found that the son of the petitioner who is aged about 20 years eloped with the fourth respondent and living somewhere else therefore he is not under illegal detention of anybody.

3. In view of the same, the petition stands dismissed. However the third respondent is directed to complete the investigation and file final report in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order [G.K.I., J.] [R.P., J.]
