PRAYER : Petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus, directing the second respondent to cancel patta issued by the third respondent in favour of the fourth respondent, with regard to the property in S.No.653/4B, by

disposing the appeal in Na.Ka.No.A3/3046/2020, pending before him within a reasonable time.

O R D E R

This writ petition has been filed seeking the issuance of a writ of mandamus, directing the second respondent to cancel patta issued by the third respondent in favour of the fourth respondent, with regard to the property in S.No.653/4B, by disposing the appeal in Na.Ka.No.A3/3046/2020, pending before him within a reasonable time.

2. Heard the learned counsel for the parties.

The petitioners preferred an appeal before the second respondent/Revenue Divisional Officer seeking cancellation of the patta issued to the fourth respondent in respect of the aforesaid properties. The second respondent, in turn, directed the third respondent to submit his report after conducting an inquiry, vide his letter dated 30.07.2020.

However, no action has been taken on the said application. Hence, the present writ petition has been filed.

4. The learned Special Government Pleader, appearing on behalf of respondents 1 to 3, submitted that the second respondent would conduct an inquiry and pass appropriate orders on merits and in accordance with law.

5. The learned counsel appearing for the fourth respondent submitted that the subject matter is pending before the Civil Court in O.S. No. 72 of 2024 on the file of the learned District Munsif-cum-

Judicial Magistrate.

6. In view of the above submissions, without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the second respondent to conduct and conclude the inquiry in Na.Ka.No.A3/3046/2020, after taking note of the pending civil litigation, on merits and in accordance with law and to pass appropriate orders within a period of eight weeks from the date of receipt of a copy of this order.

7. The second respondent is further directed to afford a reasonable opportunity to the petitioners, the fourth respondent, and all other persons who may be affected by such decision during the course of the inquiry. There shall be no order as to costs.
