ORDER
This Civil Revision Petition is filed seeking a direction to the learned Principal District and Sessions Judge, Tiruvallur to number the petition filed by the petitioner in I.A.Sr No.10648 of 2025, seeking interim custody of the minor children in GWOP No.327 of 2025.
2. The above said GWOP No.327 of 2025 was filed by the petitioner seeking custody of two minor children viz., V.S.Samartha Sri and V.Shyaam Sundar. Pending original petition, the instant application has been filed by her seeking interim custody of both the children. The said application was filed on 14.10.2025 and the same was returned by the court, raising some objections. The petitioner re-presented the papers on 27.10.2025. Again, the papers were returned by the court on 28.10.2025 stating that the petitioner failed to comply with the earlier return. Hence the petitioner has come before this court.
3. If the petition filed by the petitioner was returned by the trial court, the petitioner is expected to offer her explanation and to re-present the papers before the court. Therefore, the petitioner is directed to comply with the objections raised by the court below and re-present the papers, within a period of one week from the date of receipt of copy of the order by offering her explanations. If the trial court is satisfied with the explanations offered by the petitioner, the application shall be numbered and the same shall be disposed of in accordance with law. If the Trial Court is not satisfied with the explanations offered by the petitioner, the matter shall be called in open court and after affording opportunity of hearing to the petitioner, the Trial Court shall pass orders based on merits on the maintainability of the petition.
4. With the above direction, this civil revision petition is disposed of.
Registry is directly to return the original returned papers in I.A. Sr No.10648 of 2025 after getting it substituted with xerox copy of the same. There shall be no order as to costs.
