O R D E R

The petitioners are pensioners and they are aged about

82/80 years. They served in the Police Department, Department of Treasuries and Accounts and Public Works Department respectively and retired from service in the year 2000 and 2001. They have approached this Court that they are entitled for enhancement of pension as per G.O.42, Finance (Pension) Department, dated 07.02.2011, on attaining the age of 80 years. According to them, they are now 82 and 80 years respectively. However, the eligible enhanced pension as per G.O.42, Finance (Pension) Department, dated 07.02.2011 has not been provided to them. Therefore, they have approached this Court.

2.Mr.C.Venkatesh Kumar, learned Special Government Pleader takes notice for the respondents 1, 2 & 5 to 8. Mr.P.Gunasekaran, learned counsel takes notice for the third respondent. Mr.Abul Kalam Azad, learned Government Advocate takes notice for the fourth respondent. The learned Special Government Pleader by producing a copy of the pension pay drawn details of the petitioners submits that the petitioners' pension amount has already been enhanced on completion of their age of 80 and it was sanctioned from the first month of their age 81. Therefore, the relief sought for by the petitioners has already been granted to them.

3.Recording the aforesaid submission made by the learned Special Government Pleader that the relief sought for by these petitioners has already been granted, this writ petition is closed with a direction to the respondents to furnish a copy of the pension pay drawn details to the petitioners. No costs. Consequently, connected Miscellaneous Petition is closed.
