PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, to direct the respondents to consider the representations dated 25.04.2024, 05.08.2024, 23.04.2025 and 01.08.2025 and release the petitioner’s statutory dues, including pension,

gratuity, provident fund contributions to which he is lawfully entitled.

O R D E R

This writ petition has been filed to direct the respondents to consider the representations of the petitioner dated 25.04.2024, 05.08.2024, 23.04.2025 and 01.08.2025 and release petitioner’s statutory dues, including pension, gratuity, provident fund contributions to which he is lawfully entitled.

2. Since no adverse order is going to be passed, notice to the respondents is dispensed with.

3. The petitioner joined the services of the Allahabad Bank on

10.10.1985 as Clerk-cum-Cashier and thereafter, she served as Officer, Stationery Depot at the Zonal office, Mount Road, Chennai. She rendered 25 years of unblemished service. On 23.09.2010, a charge sheet was issued against the petitioner and consequent to the same, the Disciplinary Authority, without affording an opportunity, terminated the petitioner from service on 30.01.2012. Aggrieved over the same, the petitioner filed a statutory appeal before the Appellate Authority, i.e., Deputy General Manager, Allahabad Bank, Zonal office, Chennai on 17.03.2012. However, no decision has been taken on the said appeal. Therefore, the petitioner has sent repeated representations to the respondents on 25.04.2024, 05.08.2024, 23.04.2025 and 01.08.2025 to release her statutory dues, including pension, gratuity, provident fund contributions. Since the same was not considered, the present writ petition has been filed.

4. The learned counsel appearing for the petitioner would submit that it would suffice, if the first respondent is directed to dispose of the representation of the petitioner dated 01.08.2025 on merits and in accordance with law, within a specified period.

5. Considering the limited request made by the learned counsel for the petitioner, this Court, without going into the merits of the matter, directs the first respondent to consider the representation of the petitioner, dated 01.08.2025 and pass appropriate orders, on merits and in accordance with law, within a period of four weeks from the date of receipt of a copy of this order.

6. With the above direction, this Writ Petition is disposed of. There shall be no order as to costs.
