Prayer: Petition filed under Article 226 of the Constitution of India, seeking a writ of mandamus, directing respondents 1 to 4 to remove the illegal encroachments made by respondents 5 to 7 in S.No.32/1B, measuring abour 95.8 meters North-South and 103.6 meters East-West, with a width of about 5 meters of V.Krishnapuram Village, Chinnasalem Taluk, Kallakurichi District, which is classified as a “Nilaviyal Cart Track” in the “A” Register based on the petitioner's representation dated 30.06.2025 and

restore the same for public use.

Prayer sought herein is for a writ of mandamus to direct respondents 1 to 4 to remove the illegal encroachments made by respondents 5 to 7 in S.No.32/1B, measuring about 95.8 meters North-South and 103.6 meters East-West with a width of about 5 meters, of V.Krishnapuram Village, Chinnasalem Taluk, Kallakurichi District, which is classified as a “Nilaviyal Cart Track” in the “A” Register based on the petitioner's representation dated 30.06.2025 and restore the same for public use.

2. In respect of the land mentioned in the aforesaid prayer, though it is a patta land belonging to the private respondents or some other persons, there is a Cart Track, in tamil “epytpay; ghij”. The same has been used by local people to go to their respective lands for agricultural activities. Since the said Cart Track has been encroached upon by private parties, by thus, the ingress and egress of other people who have been hitherto using the said Cart Track is prevented. Therefore, in order to remove the said encroachment, the present writ petition has been filed.

3. Heard Mr.D.Murugan, learned counsel for the petitioner, Mr.R.P.Murugan Raja, learned Government Advocate for respondents 1 to 3 and Mr.M.Muthusamy, learned Government Advocate for respondent 4. In view of the order that is going to be passed in this writ petition, notice to respondents 5 to 7 is hereby dispensed with.
