PRAYER in W.P.No.41720 of 2025: Writ Petition filed under Article 226 of the Constitution of India, praying to issue Writ of Certiorarified Mandamus, calling for the records of the respondents issued in No. P16/ 11632976/ 1/ R1632976 dated 6.08.2024 issued by the 3rd respondent and quash the same and issue a consequential direction to the respondents not to reduce or alter the pay of the petitioner on appointment to the post of PG Assistant by way of recruitment by transfer on 19.07.2012 and to grant the selection grade pay band of vocational Instructor of Rs. 15600- 39100 plus 5400 GP continuously to the petitioner and to fix last drawn pay of Rs. 1,14,000 as against Rs/ 1,03,600 and to grant all pensionary benefits including monthly pension and to grant arrears of pension with interest at the rate of 18 percent per annum and pass For Petitioners : Mr.R.Saseetharan in both WPs For Respondents : Mrs.S.Mythreye Chandru Special Government Pleader for R1 in both WPs Mrs.Ashwini Devi Standing Counsel for R4 to R6 in both WPs Mr.V.Jeevagiridharan Additional Government Pleader for R2 in both WPs

COMMON ORDER

These writ petition have been filed to quash the order in No. P22/22/

122229093/ADK/1529 dated 25.06.2024 and the order in No. P16/11632976/1/ R1632976 dated 6.08.2024 passed by the third respondent and consequently, direct the respondents not to reduce or alter the pay of petitioners on appointment to the post of P.G.Assistant by way of recruitment by transfer on 30.07.2009 and

19.07.2012 and to sanction all the pensionary benefits.

2. Similarly placed person approached this Court in W.P.No.11882 of 2023.

This Court, by an order dated 07.03.2025, held as follows :-

“6. The learned Government Advocate appearing for the respondents 1 to 5 would submit that by virtue of interim stay granted by this Court in the instant writ petition, as early as on 20/4/2023, amount has not been recovered. He would further submit that the petitioner was retired on 31/8/2022 and his last drawn pay was Rs.1,07,500/~.

7. The learned counsel appearing for the petitioner submitted that this Court in similar matters had directed the respondents to continue to pay the selection grade pay/special grade pay to the petitioner. To substantiate his case, he has produced a copy of the order dated 11/12/2023, made in W.P.Nos.17
