PRAYER: Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Habeas Corpus, directing respondents to produce the person or body of the petitioner's daughter namely

Indhumathi aged about 21 years before this Court and set her at liberty.

O R D E R

(Order of the Court was made by G.K.ILANTHIRAIYAN, J.

This Habeus Corpus Petition has been filed to direct the respondents to produce the person or body of the petitioner's daughter namely Indhumathi aged about 21 years before this Court and set her at liberty.

2. The petitioner is the father of the detenue. The detenue is aged about 21 years. She got married with one Murugavel on 03.08.2022 and thereafter she left the matrimonial home alleging that her husband tortured her, thereby the petitioner being father of the detenue lodged a complaint before the second respondent and the same was registered in Crime No.3 of 2026 on the file of the second respondent. On investigation the second respondent found that the daughter of the petitioner though she got married with one Murugavel, even in the year 2025 she eloped with one Giridharan, thereby the husband of the detenue namely Murugavel lodged complaint before the Inspector of Police, Chengalpattu Taluk Police Station and the same was registered in Crime No.614 of 2025 and thereafter his wife was secured and produced. Once again now the daughter of the petitioner eloped with the same person/Giridharan.

3. Today she appeared through whatsapp video call and deposed that she on her own now living with Giridharan. She was compelled to marry the said Murugavel by the petitioner, therefore she does not want to live with the said Murugavel. As of now she is not under illegal detention of anybody.

4. In view of the same, the Habeus Corpus Petition is not maintainable and liable to be dismissed.

5. Accordingly the Habeus Corpus Petition stands dismissed.

However the second respondent is directed to complete the investigation and file final report in accordance with law within a period of twelve weeks from the date of receipt of a copy of this order [G.K.I., J.] [R.P., J.]
