ORDER

The petitioner had previously presented a settlement deed for registration. Refusal check slip dated 19.05.2025 was issued. The said refusal check slip was the subject of W.P.No.2154 of 2025. The said writ petition was disposed of by setting aside the refusal check slip and directing that an inquiry be held in relation thereto. According to the petitioner, in spite of issuing a representation dated 14.08.2025 in that regard, no action was taken. Hence, this writ petition.

2. Learned Special Government Pleader accepts notice for the respondent. He submits that the respondent was only directed to re-consider the matter subject to re-presentation of the document concerned by the petitioner.

3. The petitioner traces title through a decree dated 13.08.1988 in O.S.No.244 of 1986, which is a suit for partition. Pursuant to the decree, it is stated that the properties were divided in an agreed ratio and the petitioner was allotted 1.69 ¼ acre in Survey Nos.152/11A2 and 152/13A. In respect of the said properties, the petitioner also obtained a separate patta in his favour. Pursuant thereto, the petitioner intends to settle the property in favour of his son.

4. The settled legal position is that the registering officer does not have the power to adjudicate on questions of title. Therefore, subject to fulfilment of requirements in relation to registration, including payment of stamp duty and registration fees, the request for registration is liable to be accepted.

5. Therefore, the petitioner is permitted to present the settlement deed for registration within two weeks from the date of receipt of a copy of this order. Within two weeks from the date of receipt of the instrument, subject to fulfilment of conditions indicated above, necessary steps for registration shall be taken.

6. This writ petition is disposed of on the above terms. No costs.
