Respondent Prayer : Criminal Original Petition is filed under Section 528 of BNSS, 2023, to issue suitable direction to the Juvenile Justice Board, Dindigul /the learned Judicial Magistrate No.I, Dindigul, to take cognizance and take on the file of the final report (FR.No.291/2024 dated 16.08.2024) filed by the respondent police in Crime NO.347 of 2024 dated 23.05.2024 and to dispose the case on day to day basis within a stipulated time.

ORDER

Seeking to issue suitable direction to the Juvenile Justice Board, Dindigul /the learned Judicial Magistrate No.I, Dindigul, to take cognizance and take the final report (FR.No.291/2024 dated 16.08.2024) filed by the respondent police in Crime No.347 of 2024 dated 23.05.2024 on file and to dispose the case on day to day basis within a stipulated time.

2.The learned counsel for the petitioner submitted that the final report in Crime No.347 of 2024 dated 23.05.2024 was filed by the respondent police before the Juvenile Justice Board, Dindigul, on 16.08.2024. However, the same has not been taken to file by the Juvenile Justice Board, Dindigul and hence, sought for indulgence of this Court.

3.The learned Government Advocate (Crl.side) appearing for the respondent police, on instructions, submitted that totally there are eight accused in this case and charge sheet filed as against the seven accused was taken on file, trial concluded, Judgment pronounced convicting the accused imposing a punishmnet of life imprisonment. The petitioner/ accused is juvenile on the very same case, in which, the final report has been filed, however, the same has not been taken on file.

4. Recording the fact that the trial of the main case has already ended in conviction, the learned Juvenile Justice Board/ Judicial Magistrate No.1, Dindigul, is directed to take case on file forthwith on receiving the copy of the order of this Court.

5. With the above direction, this Criminal Original Petition is allowed.

6. Post the matter for reporting compliance on 18.02.2026.
