ORDER

This Writ Petition has been filed to direct the respondents 1 to 3 to cancel the patta for the property morefully described in the affidavit filed in support of this writ petition, which is now standing in the name of the 4th respondent.

2. Since no adverse order has been passed against the 4th respondent, notice to the 4th respondent is dispensed with.

3. The petitioner had given a representation to the 2nd respondent seeking for cancellation of patta for the property morefully described in the affidavit filed in support of this writ petition, which is now standing in the name of the 4th respondent. According to the petitioner, her lands have been included in the patta issued in favour of the 4th respondent and hence, the said patta has to be cancelled and a fresh patta has to be issued in favour of the petitioner, which includes the lands, for which, patta was issued erroenously in favour of the 4th respondent.

4. Admittedly, a representation was given by the petitioner to the

2nd respondent seeking for cancellation of patta standing in the name of the 4th respondent. The said fact is also not disputed by the learned Special Government Pleader appearing for the respondents 1 to 3 and on instructions, he would also submit that if a direction is issued to the 2nd respondent, the petitioner’s representation, dated 11.03.2022 seeking cancellation of patta, will be disposed of, within a time frame to be fixed by this Court, after hearing the objections, if any, from the 4th respondent and any other third party whom the 2nd respondent deems it fit to enquire.

5. No prejudice would be caused to the respondents, if the petitioner’s representation dated 11.03.2022 seeking for cancellation of patta is considered on merits and in accordance with law by the 2nd respondent, after hearing the objections, if any, from the 4th respondent as well as any other third party whom the 2nd respondent deems it fit to enquire, within a time frame to be fixed by this Court.

For the foregoing reasons, this Writ Petition is disposed of, by directing the 2nd respondent to pass final orders on merits and in accordance with law, on the petitioner’s representation, dated 11.03.2022 seeking for cancellation of patta which is now standing in the name of the 4th respondent for the property morefully described in the affidavit filed in support of this writ petition, after hearing the objections, if any from the 4th respondent and any other third party, whom the 2nd respondent deems it fit to enquire, within a period of twelve (12) weeks from the date of receipt of a copy of this order. No costs.
