Respondents PRAYER: Petition filed under Article 226 of the Constitution of India, to issue a writ of certiorarified mandamus to call for the records pertaining to the impugned proceedings of the 2nd respondent in C.O.P/R.O.C.No.126 of 2025 dated 06.12.2025 and quash the same as illegal and constitutional and subsequently simplify the procedure of renewal of Bar Council Membership and submission of Certificate of Practice (COP) and consequently extend the date of submission from 10.01.2025 to a reasonable date giving sufficient time.

This writ petition under the guise of challenging the Bar Council's election procedure is filed by an Advocate claiming to be a member of Madurai Bar Association.

2. The petitioner has challenged the impugned Circular dated

06.12.2025, issued by the Bar Council of Tamil Nadu & Puducherry, wherein the Bar Council of Tamil Nadu & Puducherry has categorized the Advocates, who have obtained their law degree before the academic year 2010 and the Advocates, who have enrolled on or after 12.06.2010 and passed All India Bar Examination prior to 2021. According to the petitioner, the said classification / categorization is discriminatory in nature. The petitioner has also questioned the demand of the educational certificates, such as, 10th Standard, PUC / Diploma / 12th Standard, UG Convocation / Provisional Certificate and Mark sheet and Law convocation / Provisional Certificate and Mark sheet, in this writ petition. According to the petitioner, since many of the aspirants have completed their 10th Standard long back, they may not be in possession of those certificates. Hence, production of 10th Standard's certificate is not an essential one, but, such a clause has been incorporated only to eliminate the aspiring candidates.

This Court, on perusing the impugned Circular, finds that the Circular has been issued pursuant to the order, dated 18.11.2025, passed by the Honourable Supreme Court of India in W.P.(C) No.1319 of 2023. In order to scrutinize the electoral role for the office bearers, the Bar Council of Tamil Nadu & Puducherry has issued the impugned Circular so as to ensure that the members of the Bar Council are properly enrolled with necessary qualifications. This sort of scrutiny is warranted, since several incidents of fake lawyers are getting themselves enrolled without proper qualifications, participating in the Bar Council elections and getting elected as office bearers. We do not find any mala fide or illegality in the process initiated by the Bar Council of Tamil Nadu & Puducherry by the impugned Circular and therefore, we are not inclined to entertain this writ petition.

4. Accordingly, this writ petition is dismissed. No costs.

Consequently, connected miscellaneous petitions are closed.
