PRAYER Contempt Petition filed under Section 11 of the Contempt of Courts Act, 1971 to initiate contempt proceeding against the 1st respondent/contemnor for wilful disobedience of the court's order passed in W.P.No. 20254 of 2024 dated

25.07.2024 and to punish the 1st respondent in accordance with law.

ORDER

This Contempt Petition has been filed alleging willful disobedience of the order of this Court dated 25.07.2024 in W.P.No.20254 of 2024, directing the respondent to consider and pass orders on the representation of the petitioner for regularisation of his purchase of land under the category of innocent buyer. 2.Today, the Assistant Commissioner of Urban Land Tax, Coimbatore, is present before this Court.

3.Learned Additional Government Pleader appearing for the respondent would submit that the order of this Court has been complied with. He produced before this Court a copy of the proceedings of the Assistant Commissioner of Urban Land Tax, Coimbatore, in Na.Ka.No.A3/2331/2018 dated 09.01.2026, rejecting the representation of the petitioner.

4.It is further submitted that, though the respondent has not disputed the entitlement of the petitioner’s right to be considered under the Government Order, they expressed their difficulty in considering the petitioner’s case since the land has already been allotted to the Tamil Nadu Slum Clearance Board and they are in possession of the property. Further, in two writ petitions which are already pending before this Court in respect of the same properties in W.P.Nos.17484 of 2019 and 17555 of 2019, status quo has also been granted by the Court, and therefore, orders have been passed rejecting the petitioner’s request.

5.As the petitioner’s representation has been considered and final order has been passed, this Contempt Petition is closed. If the petitioner still wants to establish his right, he is at liberty to file a suit and challenge the order and establish his right independently.
