PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus directing the 2nd Respondent to take control from the Interim Management Committee of the 3rd respondent Govindu Naicker Trust, in a time bound period in implementation the Letter in Ref.No.A.
0022009/dated 11.12.2019 and to carry out the Administration of the 3rd respondent Trust under the Tamil Nadu Vannikula Kahtriya Public Charitable Trust and Endowment (Protection and Maintenance) Act 2018.

ORDER

The writ petitioner had filed a petition seeking a direction to the second respondent to take control from the Interim Management Committee of the third respondent/Govindu Naicker Trust. The petitioner places reliance on the provisions of the Tamil Nadu Vanniyakula Kshatriya Public Charitable Trust and Endowment (Protection and Maintenance) Act, 2018.
2.Pending the writ petition, the writ petitioner died. WMP No.38363 of
2025 has been filed to permit substitution of legal heirs to prosecute the writ petition further. But however, the provisions of the Act could be examined even in OSA No.161 of 2013, which is pending before this Court, and filing of the writ petition is superfluous. Additionally, the writ petitioner had died on 24.01.2025 and by any mathematical calculation, the time period has also elapsed to file an application seeking substitution. WMP No.38363 of 2025 therefore stands dismissed. The writ petition also stands dismissed. No costs.
