Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Mandamus, to directing the 1st respondent to appoint Advocate Mr.C.Suresh Kumar, (Enrolment MS.No. 2992 of 2015), as Special Public Prosecutor to conduct the trial in S.C.No: 122 of 2018 on the file of the Learned Additional District and Sessions Court No-II for Trial of SC/ST Cases, Tirunelveli, by considering the petitioner's representation dated 16.10.2023 and the subsequent representation dated 07.07.2024 in the light of the Rules 4(5) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Rules, 2016, within a definite stipulated time that may be fixed by this Court.

ORDER

The present Writ Petition has been filed for the issuance of a Writ of Mandamus, to directing the 1st respondent to appoint Advocate Mr.C.Suresh Kumar, (Enrolment MS.No. 2992 of 2015), as Special Public Prosecutor to conduct the trial in S.C.No: 122 of 2018 on the file of the Learned Additional District and Sessions Court No-II for Trial of SC/ST Cases, Tirunelveli, by considering the petitioner's representation dated 16.10.2023 and the subsequent representation dated 07.07.2024 in the light of the Rules 4(5) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Amendment Rules, 2016, within a definite stipulated time that may be fixed by this Court.

2.This Court without expressing any opinion on merits is directing the respondents to consider the petitioner's representations, dated 16.10.2023 and 07.07.2024 and pass orders in accordance to law within a period of four weeks from the date of receipt of a copy of this order. While considering the petitioner's claim, the respondents shall consider all the provisions applicable to the same.

3.With the above observations, this Writ Petition is disposed of. There shall be no order as to costs. Consequently, connected miscellaneous petition is closed.
