Prayer: Writ Petition filed under Article 226 of Constitution of India, praying to issue a Writ of Mandamus, directing the Respondents to register the Birth Certificate through online for the petitioner's minor daughter namely Sindhuja, who was born on 10.04.2010 by considering the petitioner's representation dated 07.09.2023 within the time that may be stipulated by this Court.

ORDER

This Writ Petition has been filed to direct the respondents to register the Birth Certificate of the petitioner's minor daughter namely, Sindhuja, who was born on 10.04.2010 through online, by considering the petitioner's representation dated 07.09.2023.

2. The learned counsel appearing for the petitioner would submit that the petitioner has given a representation on 07.09.2023 to register the Birth Certificate of his minor daughter, namely, Sindhuja, through online.

However, the same is yet to be considered. Hence, the Writ Petition.

3. The learned Government Advocate appearing for the respondents 1 to 4 would submit that the Additional Director (District Health Officer), Birth and Death Registrar, Viswanathapuram, Madurai, is only empowered to register the Birth Certificate of the petitioner's daughter through online. However, no online application was submitted before him. He therefore prayed for appropriate orders.

4. Upon hearing both sides, this Court suo motu impleads the Additional Director (District Health Officer), Birth and Death Registrar, Viswanathapuram, Madurai as fifth respondent in this Writ Petition.

5. Mr.A.Oliraja, learned Government Advocate takes notice for the newly impleaded fifth respondent.

6. Since the fifth respondent is the competent Authority to register the Birth Certificate of the petitioner's daughter through online, without expressing any opinion on the merits of the matter, this Court directs the petitioner to submit a fresh online application to the fifth respondent in this regard. On receipt of such application, the fifth respondent is directed to register the Birth Certificate of the petitioner's minor daughter, if it is otherwise in order, within a period of four (4) weeks from the date of receipt of a copy of this order.

7. With the above direction, this Writ Petition stands disposed of. No costs.
