Challenge has been made against the impugned refusal check slip dated 22.12.2025.
2.By consent, this Writ Petition is taken up for final disposal at the admission stage itself.
3.The learned counsel for the petitioner would submit that in the present case a draft sale deed dated 18.12.2025 was presented before the respondent for registration on 22.12.2025. However, the respondent refused to register the document and issued the impugned refusal check slip stating that the property is undervalued. He would further submit that in the event, if the document is undervalued, the respondent is supposed to register the document and thereafter, refer the matter to the official concerned for the purpose of determining valuation. Instead of doing so, the respondent refused to register the same. Hence, the petitioner has filed this Writ Petition with the above said relief.
4.The learned Special Government Pleader appearing for the respondents would fairly submit that the impugned order may be set aside and remanded to the respondent for fresh consideration. If the document is re-presented and the same is undervalued, they would follow the procedure in accordance with law.
5.Considering the submissions made by the learned Special Government Pleader, this Court directs the petitioner to re-present the sale deed dated 18.12.2025 and once if it is re-presented, the respondent is directed to register the same, if it is otherwise in order. In the event, if the respondent finds that the document is undervalued, it is up to him to refer the matter to the official concerned under Section 47-A of the Indian Stamp Act, 1899. 6.Accordingly, this Writ Petition stands disposed of. There shall be no order as to costs.
