..Respondents Prayer: Writ Petition is filed under Article 226 of the Constitution of India praying for issuance of Writ of Certiorari to call for records of the impugned order bearing Na. Ka.19889/E2/2022 dated 08.08.2023 on the file of the 2nd Respondent and to quash the same as wholly illegal and arbitrary.

ORDER

An order of the second respondent cancelling document nos.372/1998, 1043/2016, 7242/2018 and 17109/2021 under Section 77A of the Registration Act, 1908 is challenged in this writ petition. All the parties agree that the power of cancellation is no longer available pursuant to Section 77A being held as unconstitutional in M.Kathirvel Vs. Inspector General of Registration and others, 2024 SCC Online Mad 6154. In view thereof, the order impugned herein cannot be sustained and is hereby set aside. All rights and contentions are left open in pending civil proceedings.

2. With the above observations, the writ petition stands disposed of.

There will be no order as to costs. Consequently, connected miscellaneous petition stands closed.
