Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to consider the petitioners representation dated 18.07.2023 and consequentially forbearing the 4th respondent from laying the cement road in the petitioners patta land in survey no. 166/7B1A measuring 0.20.00 hectares which equivalent to 50 cents in Darmapatti Village, Singampunari Taluk, Sivagangai District For Petitioner : Mr.M.Karthick For Respondent : Mr.K.Balasubramani, SGP for R1 to R3 Mr.C.Satheesh, GA for R4

ORDER

This writ petition has been filed to direct the respondents to consider the petitioners representation dated 18.07.2023

2. The learned counsel for the petitioner would submit that in this case, after the demise of his father, the subject land was inherited to the petitioner. All the revenue records, pertaining to the said land was mutated in the name of petitioner. Under these circumstances, a third party, in collusion with the 4^th respondent, made an attempt to lay a cement road through the subject land. In this regard, initially a criminal complaint was lodged by the petitioner in CSR.No.130/2023. In spite of the same, yet another attempt was made by the said 3^rd party to lay road and hence, the petitioner filed a representation dated 18.07.2023 to the respondents. However, the said representation was not at all considered by the respondent till date. Hence, this petition.

3. In reply, the learned Special Government Pleader and the Government Advocate appearing for the respondents would submit that the petitioners' representation dated 18.07.2023 will be disposed of by the 4^th respondent within a period of 6 weeks.

4. Heard the learned counsel for the petitioner and the learned counsel appearing for the respondents and also perused the entire materials available on record.

6. In view of the above, this Court directs the 4^th respondent to consider the petitioner's representation dated 18.07.2023 and dispose of the same, on merits and in accordance with law, within a period of 6 weeks from the date of receipt of a copy of this order.

7. With the above directions, this writ petition is disposed of. No cost.
