O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the first respondent to consider and dispose of the petitioner’s representation dated 23.12.2024, seeking cancellation of the patta wrongly issued in the name of Deivanai, wife of Raman, in respect of the property comprised in Survey Nos.44/11 and 146/5, measuring an extent of 52 Cents and 1 Acre and 4 Cents respectively and to restore the patta in favour of the petitioner, after conducting a proper enquiry and affording an opportunity of hearing to all concerned, within a time frame to be fixed by this Court.

With the consent of the learned counsel for the petitioner and the learned Special Government Pleader appearing for the first to third respondents, this Writ Petition is taken up for final disposal at the admission stage itself, dispensing with notice to the fourth respondent, as no adverse orders are proposed to be passed against her.

The case of the petitioner is that the subject properties comprised in Survey Nos.44/11 and 146/5, measuring an extent of 52 Cents and 1 Acre and 4 Cents respectively, are the ancestral properties of the petitioner, who inherited the same by way of succession. Since the date of purchase by the petitioner’s ancestors in the year 1949, the said properties have been in their continuous possession and enjoyment.

During the UDR scheme period, without issuing any notice to the petitioner, patta in respect of the aforesaid lands was wrongly issued in the name of the fourth respondent, who has no right or title over the property. Therefore, the petitioner submitted a detailed representation/appeal dated 23.12.2024 before the first respondent, seeking cancellation of the patta wrongly issued in the name of the fourth respondent and restoration of the same in favour of the petitioner. Since the first respondent has not passed any orders on the said representation/appeal, the petitioner was constrained to file the present Writ Petition.

The learned Special Government Pleader appearing for the first to third respondents would submit that the petitioner's representation/appeal dated 23.12.2024 would be considered and appropriate orders would be passed by the second respondent, who is the competent authority, within a period of twelve weeks.

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the second respondent to consider the petitioner's representation/appeal dated 23.12.2024 on its merits and in accordance with law and pass appropriate orders within a period of twelve weeks from the date of receipt of a copy of this order. The representation/appeal dated 23.12.2024 shall be considered and disposed of after conducting an enquiry. The second respondent is also directed to provide a reasonable opportunity during such enquiry to the petitio
