O R D E R

This Writ Petition has been filed seeking issuance of a Writ of Mandamus directing the second respondent to complete the enquiry in Na.Ka.A5/3845/2020, dated 03.02.2022, within a time frame to be fixed by this Court and to forward the enquiry report to the first respondent for appropriate action.

With the consent of the learned counsel for the petitioner and the learned Additional Government Pleader appearing for the first to third respondents, this Writ Petition is taken up for final disposal at the admission stage itself, dispensing with notice to the fourth and fifth respondents, as no adverse orders are proposed to be passed against them.

3. The case of the petitioner is that the subject property was settled in favour of the petitioner’s wife by a settlement order passed by the then Tahsildar, dated 25.10.2019. Thereafter, the petitioner and his wife have been in possession and enjoyment of the same.

Owing to interference by the fourth respondent, the petitioner filed O.S.No.35 of 2017 on the file of the learned District Munsif Court, Kulithalai, which was decreed in favour of the petitioner on 13.07.2017. However, without the knowledge of the petitioner, the fourth respondent fabricated a duplicate patta in respect of the subject property. Based on the same, the petitioner executed a settlement deed conveying the property in favour of the fifth and sixth respondents on 11.11.2019.

5. Therefore, the petitioner submitted a representation dated

14.10.2020 to the third respondent seeking appropriate action, with copies marked to the first and second respondents. Pursuant thereto, the first respondent, by proceedings dated 10.11.2021, directed the second respondent to submit a report after conducting a detailed enquiry.

6. Accordingly, the second respondent took the matter on file in Na.Ka.A5/3845/2020, dated 03.02.2022 and issued notice to the petitioner to appear on 11.02.2022. The petitioner appeared for the enquiry and submitted all the relevant documents. However, the second respondent has not disposed of the petitioner’s representation till date. Hence, the petitioner was constrained to file the present Writ Petition.

7. The learned Additional Government Pleader appearing for the first to third respondents would submit that the petitioner's representation dated 03.02.2022 would be disposed of by the second respondent within a period of eight weeks.

Recording the above submission and without expressing any opinion on the merits of the matter, this Writ Petition is disposed of with a direction to the second respondent to complete the enquiry and pass appropriate orders on the petitioner's representation dated 03.02.2022 on its merits and in accordance with law within a period of eight weeks from the date of receipt of a copy of this order. The second respondent is also directed to provide a reasonable opportunity during such enquiry to the petitioner, the private respondents and any other interested parties who may be affected by the decision. There shall be no order as to costs.
