ORDER
This writ petition has been filed seeking issuance of a Writ of Mandamus, directing the respondents 4 to 6 to change the classification of land in Survey No. 752/5, Chokkampatti Village, Kadayanallur Taluk, Tenkasi District, from “Anatheenam land” (unclaimed land) to the petitioners’ patta land and to grant patta in respect of the punja land in Survey No.752/5, Chokkampatti Village, Kadayanallur Taluk, Tenkasi District, within a time frame to be fixed by this Court.
2. Heard the learned counsel appearing for the parties.
3. According to the petitioners, they are in lawful possession and enjoyment of the punja land comprised in Survey No.752/5, Chokkampatti Village, Kadayanallur Taluk, Tenkasi District. The said land is erroneously classified in the revenue records as “Anatheenam land” (unclaimed land), which is incorrect and contrary to the actual factual position. The petitioners are entitled to have the land classified as patta land and to be issued patta in their names in accordance with law. Despite the petitioners’ entitlement, the respondents 4 to 6 have failed to take steps to correct the classification and grant patta, resulting in serious prejudice to the petitioners. Hence, the present Writ Petition.
4. The learned Special Government Pleader appearing for the respondents submits that the petitioners' representation dated 22.03.2024 will be considered on merits and in accordance with law.
5. Recording the above submission, and without expressing any opinion on the merits of the matter, this writ petition is disposed of with a direction to the first respondent to consider the petitioners' representation dated 22.03.2024, on merits and in accordance with law and pass appropriate orders after providing reasonable opportunity of hearing to the petitioners, and any other persons, who may be affected by such decision, within a period of eight weeks from the date of receipt of a copy of this order. There shall be no order as to costs.
