O R D E R

The present writ petition has been filed challenging the order passed by the first respondent on 31.07.2025 confirming the order passed by the second respondent on 27.08.2024 under the Maintenance and Welfare of Parents and Senior Citizens Act, 2007.

2. The third respondent herein, who is the father of the writ petitioner, lodged a complaint before the second respondent contending that his daughter is not taking care of her father. Based on the complaint, an order came to be passed by the second respondent directing the writ petitioner to pay Rs.4,000/- p.m. as maintenance. The third respondent lodged a complaint before the first respondent alleging non-compliance with the order passed by the second respondent. This complaint was taken up on file and disposed of on 31.07.2025 without issuing notice to the writ petitioner. Hence, the present writ petition.

3. The learned counsel for the respondents 1 and 2 submits that the first respondent has not issued any notice to the writ petitioner before passing the impugned order.

4. Though notice was served upon the third respondent and his name is printed in the cause list, he has not chosen to appear in person or through their counsel.

5. According to the learned counsel for the writ petitioner, the order of the first respondent has been passed without issuing notice to the petitioner. In view of the abovesaid facts, the order impugned in this writ petition is set aside and the matter is remitted back to the first respondent. It is open to the writ petitioner to challenge the order of the second respondent, if she is so advised.

6. Accordingly, this Writ Petition is allowed. No costs. Consequently, connected miscellaneous petition is closed.
