ORDER

The revision challenges the judgment passed in Criminal Appeal No.49 of

2024 by the Additional District and Sessions Judge, Dharmapuri confirming the judgment passed in S.T.C.No.25 of 2019 on the file of the Judicial Magistrate, Fast Track Court, Dharmapuri convicting the petitioner for the offence under Section 138 of the Negotiable Instruments Act and sentencing him to undergo simple imprisonment for one year and to pay a compensation of Rs.5,00,000/-

to the respondent.

2. During the pendency of the revision, the parties arrived at a compromise and the respondent had agreed to receive a sum of Rs.3,80,000/- in full and final settlement of all his claims against the petitioner. The parties have filed a joint compromise memo. The respondent is present in court and confirms the compromise and receipt of Rs.2,80,000/- from the petitioner. It is reported that the petitioner has already deposited Rs.1,00,000/- to the credit of STC No.25 of 2019. The respondent is permitted to withdraw the same. Since the offence against the petitioner is compoundable, this court, pursuant to the compromise arrived, is inclined to accept the Joint Compromise Memo dated 06.01.2026 and set aside the conviction and sentence imposed on the petitioner by the Trial Court.

3. Accordingly, the Joint Compromise Memo dated 06.01.2026 is taken on file. The Criminal Revision Case is allowed in terms of the Joint Compromise Memo dated 06.01.2026. The conviction and sentence imposed on the petitioner vide judgment dated 04.10.2023 in S.T.C.No.25/2019 by the file of the Judicial Magistrate, Fast Track Court, (Magisterial Level), Dharmapuri, Dharmapuri District and confirmed by judgment dated 05.06.2025 passed by the Additional District and Sessions Judge, Dharmapuri, Dharmapuri District in Crl.A.No.49/2024 is set aside and the petitioner is acquitted of the offence under Section 138 of the Negotiable Instruments Act.

4. The respondent is permitted to withdraw Rs.1,00,000/- (Rupees one lakh only) deposited before the Trial Court, with accrued interest, by filing appropriate application. Fine amount, if any, paid by the petitioner shall be refunded. Bail bond, if any, executed shall stand discharged.
