O R D E R

The Civil Revision Petition is filed challenging the order passed by the learned Judicial Magistrate, Additional Mahila Court, Alandur, Chengalpattu District in C.M.P.No.456 of 2024 in D.V.C.No.30 of 2022, dated 25.11.2024 allowing the application filed by the respondent seeking amendment of the averments in the domestic violence complaint preferred by the respondent.

2. The respondent/wife filed domestic violence case in D.V.C.No.30 of 2022 seeking compensation of Rs.50,00,000/- from the petitioner/husband for mental agony and physical abuse suffered by her. The respondent also sought for protection order under Section 18 of the Protection of Women from Domestic Violence Act, 2005. When the matter is pending, the instant amendment application has been filed seeking to delete certain words in Paragraph Nos.10 and 11 of the affidavit filed by the respondent. The said amendment application was allowed by the learned Judicial Magistrate and aggrieved by the same, the petitioner/husband has come before this Court.

The learned counsel appearing for the petitioner would submit that the respondent in the original affidavit filed by her made certain serious allegations against the petitioner, which would affect the reputation of the petitioner. The same was stoutly opposed by the petitioner by filing counter. Now, the respondent wants to withdraw the unsustainable allegations made against the petitioner and the same shall not be permitted without any justifiable reason.

In the affidavit filed in support of the amendment application, it was stated by the respondent that allegations made against the petitioner regarding his character were included in the affidavit by the previous counsel, without understanding the instruction given by her and therefore, the said allegations shall be deleted from the pleadings of the respondent. Infact, in the affidavit filed in support of the amendment application, it was asserted by the respondent that she never had intended to make such allegations against the petitioner.

5. The learned counsel appearing for the petitioner mainly submitted that the allegations sought to be withdrawn by the respondent would cause serious prejudice to the reputation of the petitioner.

6. Now, the respondent realised the mistake and agreed to withdraw the allegations made against the petitioner. Allowing the same will not cause any prejudice to the petitioner. The learned Judicial Magistrate having satisfied with reasons assigned by the respondent, allowed the respondent to withdraw the allegations made against the petitioner regarding his character and the said order will not cause any serious prejudice to the petitioner and infact, the allowing of the amendment application will remove the serious allegations made in the pleadings of the respondent from the record. Therefore, I do not find any illegality or irregularity in the order passed by the learned Judicial Magistrate, Additional Mahila Court, Alandur, Chengalpattu District in C.M.P.No.456 of 2024 in D.V.C.No.30 of 2022, dated 25.11.2024.

7. Accordingly, the Civil Revision Petition is dismissed. No costs.

Consequently, the connected civil miscellaneous petition is closed.
