2. The writ petitioner is an educational institution imparting education from 10^th standard under ICSE sylabus. They challenge the order passed by the Private Schools Fee Determination Committee. Our attention is drawn to the order dated 28.01.2016 pased by the Hon'ble Supreme Court in SLP(C)No.16 of 2013 (Asso. of Management of Pvt. Schools(CBSE) & Anr Vs. State of Tamil Nadu & Ors.). The Hon'ble Supreme Court had passed the following order:-

“Leave granted.

In modification and supersession of our interim order dated 15.01.2015, we direct that for I.C.S.E. and C.B.S.E. Schools, the regulatory mechanism of the Fee Committee shall be limited, during the pendency of the present controversy, to the one contemplated under Section 7(3) of the Tamil Nadu Schools (Regulation of Collection of Fees) Act, 2009.”

3. We dispose of this writ petition by holding that the direction given by the Hon'ble Supreme Court will be applicable to the petitioner's school also.

4. It is open to the petitioner to file a fresh writ petition based on the final outcome of the case pending before the Hon'ble Supreme Court. No costs. Consequently, connected miscellaneous petitions are closed.
