PRAYER Writ Petition filed under Section 226 of the Constitution of India, for issuance of a Writ of Mandamus, directing the respondents to extend the benefit of judgment rendered in W.P.No. 28639 of 2023 dated 30.01.2024 to the petitioner by enrolling him in Old Pension Scheme and grant him all consequential monetary benefits.

ORDER

This Writ Petition has been filed seeking to direct the respondents to extend the benefit of judgment rendered in W.P.No. 28639 of 2023 dated 30.01.2024 to the petitioner by enrolling him in Old Pension Scheme and grant him all consequential monetary benefits.

2. Mr.S.Ravichandran, learned Additional Government Pleader takes notice on behalf of the respondents. In view of the consent expressed by the learned counsel on either side, the Writ Petition is taken up for final disposal at the stage of admission itself.

3. The case of the petitioner is that he was originally recruited and allotted to Revenue Unit, Tiruvannamalai District by TNPSC vide proceeding dated 07.07.2001. Since there was no vacancy, his name was surrendered to TNPSC and subsequently, he was re-allotted to the Hindu Religious and Charitable Endowments Department vide communication dated 23.12.2003.

Pursuant to which, the petitioner was issued with an allotment order dated 02.01.2004 by the second respondent. Since the petitioner was governed under the new Contributory Pension Scheme introduced for employees with effect from 01.04.2003, he made a representation dated 25.08.2025 to the first respondent herein, seeking to enroll him in Old Pension Scheme and grant him monetary benefits, as his first appointment was prior to the cut-off date i.e 01.04.2003. However, the same has not been considered till date. Therefore, the petitioner has preferred the present Writ Petition.

4. Learned Counsel appearing for the petitioner submits that it would suffice, if this Court issues a direction to the first respondent to consider the representation of the petitioner dated 25.08.2025 and pass appropriate orders on the same within the time that may be stipulated by this Court.

5. On the above contention, this Court heard the learned counsel appearing for the respondent.

6. In view of the limited relief sought for by the petitioner, this Court without expressing any opinion on the merits of the case, directs the first respondent to consider the petitioner’s representation dated 25.08.2025 and pass appropriate orders on the same in accordance with law within a period of six (6) weeks from the date of receipt of a copy of this order, after affording an opportunity of hearing to the petitioner and any other interested parties.

7. This Writ Petition stands disposed of with the aforesaid direction.

There shall be no order as to costs.
