ORDER

Seeking to transfer the investigation in Crime No.65 of 2025 on the file of the third respondent to the fourth respondent, this criminal original petitio has been filed.

2. The petitioner is the defacto complainant in the matter. The claim of the petitioner is that one of his son, namely, Aadhish, aged about 16 years, was forcibly taken away from their house by Guruvel, and Swaminathan and confined him at another place, where he was threatened with dire consequences and physically assaulted. It is further alleged that he was strangulated by the aforesaid persons and others, and thereafter brought back to the petitioner’s house and hanged from a fan, projecting the incident as a case of suicide. Alleging that the investigation has not seen any progress, the petitioner has sought transfer of the investigation from the file of the third respondent to the file of the fourth respondent

3. The learned Government Advocate (Criminal Side) appearing for the respondent submitted that the case pertains to an allegation of stalking, in which the petitioner’s son, Atheesh, was involved. It was stated that he had sent messages through Instagram to the cousin sister of the accused persons. Upon receiving information from the girl, the accused persons allegedly forcibly took the minor boy, Atheesh, to a secluded place and threatened him with dire consequences. Thereafter, the victim boy returned to his house and subsequently committed suicide. . In this regard, complaint has been received from the defacto complainant as it is not a suicide, but murder. Since the petitioner is not satisfied with the investigation conducted by the third respondent, it was brought to the notice of the second respondent, who in turn, by proceedings dated 02.06.2025 had already nominated the Deputy Superintendent of Police, Manamadurai, as investigating Officer to investigate the crime in question and on completion of investigation, now final report is filed by way of e-filing before the learned Judicial Magistrate, Manamadurai.

In view of the same, this Court is of the considered view that the petitioner's grievance has already been ventilated by the second respondent/ Superintendent of Police by nominating a Specific Officer in the cadre of Deputy Superintendent of Police for conducting investigation in the matter. Since the investigation has now been concluded, no further necessity prevail to keep this original petition pending. Accordingly, this Criminal Original Petition is closed. Consequently, connected Miscellaneous Petition is also closed. Since the final report in Crime No.65 of 2025 has been filed by way of e-

filing, the learned Judicial Magistrate, Thirupuvanam, is directed to take cognizance.
