PRAYER : Petition filed under Section 528 of BNSS, 2023, to direct the second respondent to execute the bailable warrant dated 29.08.2024 issued by the learned Judicial Magistrate, Valliyoor within a time stipulated by this Court.

ORDER

Seeking to direct the second respondent to execute the bailable warrant dated 29.08.2024 issued by the learned Judicial Magistrate, Valliyoor, this petition is filed.

2.The learned counsel appearing for the petitioner submitted despite the lapse of more than one year, the pending warrant has not been executed by the second respondent .

3.The learned Government Advocate (Crl. Side) on instructions, submitted that so far no bailable warrant has been received by the second respondent.

4.In view of the above, the second respondent is directed to verify with the concerned Court as to whether any bailable warrant was issued on 29.08.2024 against the third respondent in S.T.C. No. 661 of 2024 on the file of the learned Judicial Magistrate, Vallioor. If any such warrant has been issued, the second respondent police shall take appropriate steps in accordance with law within a period of four weeks from the date of receipt of a copy of this order.

5.With the above directions, this Criminal Original Petition stands disposed of. 08.12.2025 NCC : Yes / No Index : Yes / No vsg TO:-

1.The Judicial Magistrate, Valliyoor.

2.The Superintendent of Police, Kanyakumari District at Nagercoil.

3.The Inspector of Police, Vallioor Police Station, Vallioor, Tirunelveli District.
