PRAYER : Writ Petition filed under Article 226 of the Constitution of India praying for issuance of a Writ of Certiorarified Mandamus, to call for the records of the order of the second respondent in Ka.No.6916/L6-/TNSTC (Villupuram/TN/2023 dated 22.08.2023 and action of the respondents to pay difference of terminal benefits of gratuity, commutation and leave salary interest at the rate of 9% per annum, as per 12th wage settlement along within

the stipulated time as may be fixed by this Court.

O R D E R

This Writ Petition has been filed challenging the order of the second respondent in Ka.No.6916/L6-/TNSTC (Villupuram/TN/2023) dated 22.08.2023 and for a consequential direction to the respondents to pay difference of terminal benefits of gratuity, commutation and leave salary interest at the rate of 9% per annum, as per 12th wage settlement within a stipulated time fixed by this Court.

The learned counsel appearing for the petitioner submits that the petitioner joined the service of the first respondent Corporation as Conductor on 10.02.1981 and his service was regularized in the year 1982. He was subsequently promoted and was lastly working as Traffic Inspector at Thirukovilur Branch in the first respondent Corporation. The grievance of the petitioner is that his terminal benefits was not properly calculated as per 12(3) settlement entered into between the Managment and the workers. As per the said settlement, the petitioner is entitled for 5.5% in the basic pay with effect from 01.09.2013 and therefore, the petitioner has earlier filed W.P.No.6916 of 2023 seeking direction to the respondents to pay difference of terminal benefits of gratuity, leave salary which was disposed of by order dated 06.03.2023, directing the concerned Authority to examine the representation made by the petitioner. Subsequently, on 22.08.2023, the petitioner’s claim was rejected by order dated 22.08.2023 by the second respondent. Hence, the petitioner has preferred this writ petition seeking the aforesaid prayer.

Though very many grounds have been raised in the affidavit filed in support of this petition, when the matter is taken up for hearing, the learned counsel appearing for the petitioner submits that it would suffice if this Court permits the petitioner to file a fresh representation seeking pension and due amount.

4. Heard the learned counsel appearing for the petitioner and the learned counsel appearing for the respondents.

5. In view of the limited request made by the learned counsel appearing for the petitioner, this Court, without interfering with the impugned order passed by the second respondent, permits the petitioner to file a fresh representation before the respondents seeking pension and dues if any, within a period of four weeks from the date of receipt of a copy of this order. On receipt of such representation, the respondents are directed to consider the same and pass appropriate orders within a period of 12 weeks thereafter.

6. Accordingly, this Writ Petition is disposed of. There shall be no order as to costs.
